My husband received a notice in the mail on the 14th of month, (the letter was dated on the 12 of the month) from his health fund administrator. It stated that his insurance has been terminated and we needed to decide if we elected COBRA benefits or not. If we decided to elect COBRA we needed to pay the first month premium of $785 by the 23rd of the month. This was less than 10 days. The qualifying event was "termination". My husband's company is on strike and collecting a small strike fund. I thought we had 60 days to decide if we elected coverage and 45 days to pay the premium if we did make the election. Is this legal?
