The employee would still be covered under the company health plan; however, what kind of medical leave did he take? Is it FMLA? Is the employee totally disabled? When does he expect to return? Did he submit a doctors statement with his request for leave? If you don't have this information, you need to request it from the employee ASAP because the chances of incurring legal liability in this situation are very high.

The employee would have to terminate his employment in order to be COBRA eligible. Sounds to me like he hasn't terminated employment, he's just out on medical leave??? Does your company have an HR Department to help you with this situation? There is so much compliance associated with LOAs -- it sounds like you need advise from someone familiar with Federal and State laws regarding LOAs to help you out -- especially if this started last in September.
