In the state if CA, I had elective surgery scheduled and performed while insured under cobra. The surgery was performed during a grace period, and later my insurance was retroactively cancelled due to a missed payment. I am now shouldered with the debt. Do I have any options other than pay the entire amount ($50,000) which would be impossible for me at this point. I do know that the hospital was not informed of the grace period status when verifying my insurance as required in the cobra by laws. I realize this clause is meant to help the hospital avoid risk, but can I use it at all to my benefit?
