No, the laws/regulations do not require that. I could give some examples about why it wouldn't work, but it's not really relevant. There is basically 44 days for the employer or administrator to get the COBRA letter to you. If you already went to the doctor, then you need to decide whether to elect the COBRA, so those claims will be paid, or whether it might be cheaper for you to pay the claims directly, since COBRA can be quite expensive. If you know you will need other medical appointments, then you would probably want to elect the coverage. The coverage would be retroactive back to December 1st, so you won't have a lapse.
