My son worked as a contractor in Dallas, TX for a firm that was based out of Mass. After his termination he took the COBRAInsurance through BC/BS in Mass until it terminated 4/1/04. He rec'd his HIPPA letter and called BC/BS in Texas about individual health ins. and they said they couldn't offer him health ins. due to preexisting illness. They said if he had transfered his health coverage before COBRA expired they could cover him. He explained he tried to do that back Jan. 2004, but BC/BS Texas said he couldn't transfer until coverage expired. Now BC/BS Texas said they can't offer him individual coverage. I thought no matter what, if a company offers individual health coverage that they must offer it to you due to the HIPAA Law.
Your help in this matter would be greatly appreciated.
