Our law firm has 2 of these type of cases currenly ongoing. We try to get the insunrace compnay of the bankrupt insured to pay. Plus there is case law out there that will allow you to sue the insurance company since it failed to tell you the employer was not paying the premiums. To take advantage of that case law you need to sue in a certain part of the country.
: The employer canceled our life/disability ins. (No cobra) They filed chapter 11 against the ins. co. (6 monthss of premiums not paid) What happened to our money we contributed, how can we get it back, the employer was asked if he owed his ee's wages and he say all employees are fine. It is past the date to put in a claim with the BK court, now what? The ee's who want to contiunue coverage are now being asked to pay what the employer did not pay if they want to contiune coverage.
