There is a definition of misconduct for COBRA. Just because you consider something misconduct does not mean it meets the definition of misconduct for the purposes of disqualifying someone from COBRA. It generally has to be violence, fraud, or something along those lines. Disobeying your supervisor or gross incompentence usually does not count as 'misconduct' for COBRA purposes. I would say do your research carefully or speak to a lawyer before you open yourself up for possible penalties.
: As an employer and I terminate a person for misconduct, do I have to offer them Cobra or is it up to me if I want to or not? Do they automaticaly disqualify from Cobra ?
