If a married couple is separated and the spouse terminates his wives insurance coverage (checks divorce-soon to be, due to nothing
stating separated)
Is this legal when we are still married?
Plus the employer then sends me a Cobra letter stating that I can
receive
coverage "due to a divorce".
I was advised that if I took the Cobra under the falsified reason, this would be considered fraud, so I did not-
I was also advised that the employer had to have a supporting divorce
decree to terminate my coverage, is this true?
We are still currently married (6/2/04) and my coverage was terminated effective 7/18/03.
My health is extremely bad and I am needing to know my rights. I have nothing to offer an attorney, so any advise would be greatly
appreciated!
