Employee Elected Cobra coverage on the 60th day of eligibility and then never paid by the 45th day. In the mean time the Company has paid the premiums and the employee has used the medical coverage.

What options does the employer have for recuperating the premiums that were paid by the Company but not reimbursed by the employee?

Do the Health Insurance companies have the option to reverse the claim and then make the employee responsible for their healthcare cost?

I can't imagine the COBRA laws were written so that employers have to be responsible for benefit coverage when the employee refuses to pay but has elected and subsequently used the coverage.

Please advise.
