I live in Atlanta, Georgia. My COBRA ended with my previous employer in May 2004. In February of 2004, I started a new job and was brought on to the new company's insurance (Guardian)in May 2004. My employer currently has 10 employees including myself. I am quitting at the end of July.
When I asked my employer about COBRA (costs, etc.) she told me that technically she doesn't have to offer COBRA. I didn't think this was possible in any state, but I thought the state of Georgia had some type of protection against this. Since I am a 5-year kidney and pancreas trasnplant recipient (which she knows), I'm wondering if this is just a tactic to scare from going through with my resignation.
What are my options? And is that legal for a small company based in Georgia to say that they don't have to offer COBRA?
Please advise. If that is the case, then I can forget it because my antirejection meds alone per month are about $800.
