The 60-day election period is 60 days from the later of (a) the date they send you the COBRA election notice or (b) the last day of your coverage under the plan. If your last day of coverage was September 30, you still have time to elect within the 60-day period. Tell them you don't have the election materials, that you want them NOW, so that you can make a timely election on their forms within the 60-day election period. Follow that up with a letter saying the same thing. Send it certified mail, with return receipt requested. In the letter also say that you are electing COBRA for yourself and your family memembers (so you've elected it anyway), and that you want a statement of the required premiums and when they are due. Make a photocopy of everything you send.
Finally, complain NOW to the U.S. Department of Labor, Employee Benefit Security Administration. You can find the telephone number for the nearesr office of the EBSA at the Department's website: www.dol.gov/ebsa. Tell them exactly what's happened, and give them a name and a phone number they can call at the employer or plan. Do that today, don't wait.
